Upon the 27th 'day of March, 1889, the defendant signed his name to the following agreement:

“West Branch, Mich., Mar. 27, 1889.
“To The National Cash Register Company,
“Dayton, Ohio:
“Please ship to us, at our place of business, West Branch, Michigan, as soon as possible, one of your No, 2 registers, as per your illustrated catalogue. Said register to be equipped with all the latest improvements. *466Cabinet to be nickel. Denominations of keys to be 1 c. to $10. Check key.
“On the fulfillment of the above we agree to pay to you one hundred and seventy-five dollars, viz.: $25.00 cash; bal. $25.00 a…
