This suit grew out of the accidental explosion of a time-bomb while in the process of being assembled for shooting an oil well. Injuries were inflicted upon Fred D. Herrington an employee of Texas Pacific Coal & Oil Company. Texas Pacific Fidelity & Surety Company was the compensation insurance carrier of the oil company. Independent-Eastern Torpedo Company made a contract with the oil company to shoot the well, and furnished the necessary materials and labor. Herrington was found to have been injured through its…
