1. INTRODUCTION
D.B. Zwirn Special Opportunities Fund, L.P. (“D.B.Zwirn”) brings this action against Tama Broadcasting, Inc. (“Tama”) and certain of its subsidiaries for breach of contract stemming from Tama’s failure to fulfill its payment obligations under financing agreements entered into with plaintiff. Presently pending before the Court is plaintiffs motion by order to show cause for the appointment of a temporary receiver to protect defendants’ assets, which serve as collateral to those agreements.
