Plaintiff was Clerk of the county of New York for the period commencing January 1, 1930, and ending December 31, 1933, and Sheriff of the county of New York for the period beginning January 1, 1934, and expiring on December 31, 1937. At the time of his election to each office and during his incumbency thereof the Constitution of 1894 was in effect. As Sheriff and as Clerk, he was a constitutional State officer and, in each case, elected for a fixed term of three years (State Const. art. 10, § 1).
