Plaintiff brought this declaratory judgment action seeking a determination that a written agreement for the sale of assets of a sole proprietorship entitles plaintiff to the cash assets of the business. After a trial without a jury, the court agreed and entered judgment for plaintiff for $31,800, plus costs and attorney fees.
