DECISION AND ORDER

ADELMAN, District Judge.

Plaintiff Stanley Dorf sues Ron March and several businesses controlled by March (collectively “defendant”) for breach of contract. On October 1, 1993, plaintiff entered into an agreement with defendant pursuant to which plaintiff advanced defendant $225,000 for the purpose of developing a shopping center. The agreement required defendant to commence the project or return the money to plaintiff with interest. Plaintiff alleges that defendant did neither.
