¶ 1. Kenivel Smith was convicted of aggravated assault and sentenced to serve twenty years in the custody of the Mississippi Department of Corrections for the shooting of Andre Davis. At trial, Davis testified to a version of events different from that which he had first related to law enforcement officials, refusing to identify Smith as the shooter.
