This is an appeal from a judgment of the Circuit Court of Cook county, in favor of the appellees against the appellant for $386. The facts are simple and almost undisputed.

The appellees were produce and fruit commission men doing business on South Water street in Chicago. During the apple season of the year 1899, and for eight years previous, they shipped several cars of apples a day into Chicago from outside points.
