This is a motion made by the defendant Murdock to stay, pending the final determination of this suit, an action brought against him in the City Court by the defendant Bostwick, as trustee in bankruptcy for the defendants Greene and Ward.

The facts leading up to this application are briefly as follows: The present action is the usual statutory proceeding for the foreclosure of a mechanic’s lien. It appears that in' March, 1901, the defendant Wasserman contracted with the defendant Murdock as principal contractor for work and materials in and about a building on premises owned by him.…
