The defendants were charged in separate counts with conspiring to aid and abet in the placing of an explosive with intent to de stroy and conspiracy to murder one Myron J. Whipple. After a nonjury trial, the court found defendants guilty of the second count, conspiracy to murder. The defendants were sentenced to 15 to 25 years in prison.
In his opinion, the trial court set out the following statement of facts:
"On April 25, 1974, during the evening hours, an explosion occurred outside of the front portion of the residence of Robert Schlosser, a Midland Police Officer, located at 408 Cottonwood…
