DALTON, Judge.

Action for $75,000 damages for personal injuries alleged to have been sustained by reason of defendant’s negligence. The cause was tried to the court, without the aid of a jury, and judgment was entered for defendant. Plaintiff has appealed.

The accident happened on September 30, 1952, about 3:20 p. m. on Highway No. 17, within one mile south of the junction of U. S. Highway No. 54 with State Highway No. 17. All of the parties, hereinafter mentioned, were returning from a baseball game at Parker Henley field on U. S. Highway No. 54 about a mile west of the mentioned junction.…
