Appellant Carl Bradley Johansson (“Jo-hansson”) pled guilty to a conspiracy to violate federal regulations which limit the number of hours operators of motor carriers may drive, and to conceal such violations by falsifying records required to be maintained by the United States Department of Transportation (“DOT”). He appeals the district court’s enhancement of his sentence pursuant to U.S.S.G. § 2F1.1(b)(6)(A) 1 for a fraud offense that involves the conscious or reckless risk of serious bodily injury.
