JOHNSON, Justice.
This is an original application filed on July 14, 1958, by Marion R. Smoker, a qualified elector, seeking a writ of man damus to command the Secretary of State, hereinafter referred to as respondent, to take no action which would cause the name of William T. Brooks to be listed upon the ballot at the primary election to be held September 9, 1958, as a candidate for the corporation commission.
