MEMORANDUM DECISION

BECK, District Judge.

These cases with federal jurisdiction invoked under 28 U.S.C. § 1345 have been combined for purpose of trial, each being a suit by the government against the respective defendants to recover proceeds from sales, at their sales pavilions of some livestock out of a herd mortgaged by Wesley A. Griffin to the Farmers Home Administration. Both cases are on the theory that the defendants were agents of the mortgagor, converters too, as they transferred the proceeds to him and that the government on that basis and on rules of law to be applied in one case has…
