— Affirming.

Virgil Caldwell appeals from a judgment convicting him of the crime of maliciously shooting and wounding Florence George and fixing his punishment at five years confinement in the penitentiary.

It is the contention of the commonwealth that this shooting and wounding of the prosecutrix, Florence George, was malicious and without provocation.

Her evidence is to the effect that the accused, a colored man, and the prosecutrix had been., intimately going together for some two years and that he was urging her to go with him to Illinois and marry him; that…
