Reversing.
Appellant, Thornton Meade, who was under 17 years of age at the time, was indicted and tried in the Boyd circuit court for an attempt to rape an infant under the age of twelve years, an offense denounced by section 1153 of our statutes. He was convicted and sentenced to serve a term of five years in the penitentiary. His motion for a new trial was overruled and from the judgment pronounced on the verdict he prosecutes this appeal, urging as reversible errors, (1) the admission of incompetent testimony offered by the Commonwealth; (2) error…
