MEMORANDUM OPINION

KOYACHEVICH, District Judge.

This is a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 brought by a state prisoner under sentence of death. The petition was filed on July 9, 1990, together with an application for stay of Petitioner’s execution then set for July 10, 1990. In order that Petitioner’s claims could be judiciously considered, the Court entered a stay of execution on July 9, 1990, and deferred ruling on the petition until the Eleventh Circuit Court of Appeals resolved the issue of whether execution in the Florida electric chair is cruel and unusual…
