A jury found appellant, Antonio Delacruz, guilty of capital murder and the trial court assessed punishment at life imprisonment in the Institutional Division of the Texas Department of Criminal Justice. See Tex. Penal Code Ann. § 19.03(a)(2) (Vernon 2003). In three issues, appellant argues (1) the evidence is factually insufficient to prove he intentionally caused the death of the complainant, (2) the evidence is factually insufficient to prove the aggravating element of intent to commit robbery, and (3) the trial court erred by refusing to instruct the jury…
