RABINOWITZ, Superior Court Judge.

The principal issue raised in this appeal involves construction of Rules 52(a) and 63(c) of the Rules of Civil Procedure.

On November 9, 1955 appellee, a purchaser under an executory contract, filed a two count complaint against appellant seeking immediate possession of the subject real property and improvements thereon together with the rents and profits therefrom; an accounting from appellant relative to the subject property; and reductions from the balance owing by appellee to appellant on the purchase price for the subject premises.
