This is an appeal from a judgment entered on the pleadings in a wrongful death action.

The historical facts in chronological order may he summarized as follows:

Plaintiff, as administrator of the Estate of Margaret Stuchko, deceased, filed a complaint in trespass on October 18, 1960, alleging a cause of action against the defendants based on the Act of April 15, 1851, P.
