MEMORANDUM OPINION AND ORDER

Before the Court are the Rule 12(b)(6) Motion To Dismiss, or in the Alternative, *574Traditional/No Evidence Rule 56 Motion for Summary Judgment filed by Defendants City of Grapevine (the “City”) and Edward Salame, the City’s Chief of Police, and the Motion for Partial Summary Judgment filed by Plaintiff Matthew Petrie. For the reasons stated below, both motions are granted in part and denied in part.
