INTRODUCTION

Plaintiffs bring this action against the defendants for alleged hazardous waste contamination of plaintiffs’ property in Nassau County, New York. The Complaint contains claims pursuant to the Comprehensive Environmental Response, Compensation and Liability Act (“CERCLA”), 42 U.S.C. §§ 9601 et seq., as well as state law claims. Defendants Liberty Industrial Finishing Corp. (“Liberty Industrial”) and the government separately move to dismiss the state law claims, Causes of Action Four through Nine.
