PHILLIPS, Circuit Judge.

The Mason Corporation and Richard C. Mason brought this suit against Erie P. Halliburton and Halliburton Oil Well Cementing Company for alleged infringement of patent No. 1,408,113 applied for January 28, 1921, and granted February 28, 1922, to Richard C. Mason. The defenses were invalidity and noninfringement.

The patent in suit covers a well measuring device. It comprises a rectangular-shaped frame mounted on the upper end of the well casing. One side of the frame is convex and attached on the inside thereof is a U-shaped bracket. The upper and lower ends of the frame…
