The defendants were indicted for the murder of Fleming Smith, and upon their trial the jury rendered a verdict of guilty, with a recommendation to mercy. To the order of the court refusing a new trial they excepted. Fleming Smith, the deceased, was a clerk in the drug-store of the Jesup Drug Company, and it was in this store that the shooting occurred, on the night of December 12, 1908, which resulted in his death. A witness for the State, J. J. Hill, testified that on the morning of the day on which the killing occurred, W. B. Lyens, one of the defendants, stated to him: “I cursed him…
