Action to recover damages for personal injuries sustained as the result of an explosion of vapors in an unused, underground gasoline storage tank installed in a public alley in the city of Mankato.

Before the close of plaintiff’s case, he voluntarily dismissed the action as to defendant city, and at the close of his case he voluntarily dismissed as to defendant S. Howard Weller, the owner of adjoining premises and lessee of the tank.
