Portia Boulger filed an action for defamation and invasion of privacy based upon a tweet by James Woods, a well-known movie actor and producer. The district court denied Woods's motion for summary judgment, due to Boulger's lack of service, but granted his motion for judgment on the pleadings, finding that the tweet was not an actionable statement of fact under Ohio law. Boulger now appeals the grant of the motion for judgment on the pleadings as to her defamation claim, and Woods cross-appeals the denial of his motion for summary judgment.
