The indictment, besides charging the offense, alleged that on November 16, 1920, appellan; was convicted in the city court of a violation of chap'./’ • 4, Acts-1917 p. 15. The judgment was a fine of $2C ' and imprisonment on the Indiana State Farm for sixty days. His motion for a new trial was overruled, and this ruling is the only error assigned.
