One Nils Swenson, a farmer 72 years old, was convicted in the circuit court of Clay county, upon the charge of murdering Bertha Swenson, his daughter-in-law, by administering strychnine poison. Upon a proper bill of exceptions a new trial *591was granted the accused and from the order granting a new trial the state appeals. The motion for a new trial was based upon errors of law occurring at the trial, including errors alleged in certain portions of the charge of the trial court, and upon the ground of insufficiency of the evidence to- sustain a conviction.
