The defendant was convicted of the crime of embezzlement and appeals from the judgment and from an order denying his motion for a new trial. The indictment consisted of five counts and the jury returned a verdict of guilty upon the first, fourth, and fifth counts.
The charges upon which appellant was convicted were, respectively, that as the agent and bailee of one Clara B. Burg, he did during the months of June and July, 1925, wilfully, unlawfully, fraudulently, and feloniously convert, embezzle, and appropriate to his own use a $3,500 promissory note of the value of $1,525, $300 in cash, and…
