Although all controverted questions of fact were settled by the judgment of the Appellate Court, a considerable portion of an elaborate brief and argument of appellant is devoted to a discussion of the facts. It was appellant’s contention on the trial that the injury to appellee resulted from the giving way of the brick wall he had built, and not from the giving way of the stone foundation wall, as alleged in the declaration.
