The plaintiff, Charles Vacker, recovered a verdict and judgment in the Circuit Court of Vermilion county against the defendants, M. Yeager and O. P. Yeager, partners doing business as M. Yeager & Son, for the sum of $7000' as damages for personal injuries. The declaration contains two counts. The first count alleges that the defendants on June 25,1907, had the contract for the erection and construction of a seven-story building in the city of Danville; that Joseph A.
