Trespass, for injuries to real estate. Appeal from, the Superior Court of Cook County; the Hon. Nathaniel C. Sears, Judge, presiding. Heard in this court at the October term, 1897. Reversed and remanded. Opinion filed December 16, 1897.

Appellant brought this action to recover from appellee damages which he claims to have sustained as owner of sixteen lots fronting on what is known as Bloomingdale road, upon which road appellee has built and is operating its railroad. This suit has been tried twice. On the first trial the case was taken from the jury by the court, and judgment rendered for appellee, which judgment was reversed for the reason that the record disclosed a conflict of evidence on alleged matters of fact which should have been submitted to the jury. 41 Ill.
