In the year 1889 the Monongahela Natural Gas Company entered into an agreement with the Birmingham and Brownsville Macadamized Turnpike Road Company which was evidenced by a writing under seal duly executed by the two corporations. The contract provides: “That for and in consideration of the agreements and covenants . . . ., to be kept and performed by the .... Gas Company, the .... Turnpike Company, . . . ., hereby grants a right of way to the .... Gas Company, its successors and assigns for the purpose of laying pipes and maintaining a gas pipe-line ....…
