PETERS, C. J.

This is an action by the beneficiary under an accident insurance policy of the Preferred Accident Insurance Company of New York, by tbe terms of which the insured, Dr. Harvey L. Eoss, the husband of the beneficiary, was insured against disability or death “resulting directly, independently and exclusively of any and all other causes from -bodily injury effected solely through external, violent and accidental means.” The beneficiary had judgment below and the insurance company prosecuted this writ of error.
