OPINION

ENSLEN, District Judge.

Presently before the Court in this case is defendants Township of Benton, Jack Drach, and Keith Diamond’s February 12, 1986 Motion to Dismiss. For the reasons discussed below, the Court will deny defendants’ motion in part and grant it in part.

Facts

Plaintiff filed her complaint in this matter on December 17, 1985. As part of her complaint, plaintiff alleges that defendant Diamond had violated her constitutional rights to equal protection of the laws and equal privileges and immunities under the law by failing to act on her report of abuse by her husband, and thus…
