This is an action to recover damages for personal injuries alleged to have been sustained by plaintiff in a collision of two of defendant's trains. There was a verdict and judgment in plaintiff's favor in the sum of $20,000. Defendant railroad appealed.

A brief statement of the case will suffice. Plaintiff, a pullman porter, was assigned on August 10, 1947, for duty on the rear car of a train on a run from Ft. Worth, Texas to St. Louis, Missouri.
