I. INTRODUCTION
This case comes before the court on the defendants’ motion to dismiss and for attorneys’ fees and expenses. The plaintiff alleges that the defendants misrepresented themselves as small or disadvantaged businesses in violation of the False Claims Act (“FCA”), 31 U.S.C. §§ 3729 et seq., to obtain orders from the Immigration and Naturalization Service (“INS”) for advertising and public relations services.
