MEMORANDUM OPINION
RICHARD J. LEON, District Judge.
This matter is before the Court on pro se plaintiff Joseph Zernik’s petition for a writ of mandamus and plaintiffs motion to disqualify this Court [Dkt. # 3]. For the following reasons, the Court will deny the motion to disqualify and dismiss the petition sua sponte for failure to state a claim upon which relief can be granted.
