hThe defendant, Sylvester Mead, was adjudicated a third felony habitual offender pursuant to La. R.S. 15:529.1(A)(l)(b)(ii). He was sentenced to the mandatory sentence of life imprisonment without benefit of probation, parole, or suspension of sentence. The trial court held a hearing pursuant to State v. Johnson, infra, to determine if a downward departure of the defendant’s mandatory life sentence was warranted. The trial court determined that a downward departure was not warranted, and the defendant’s term of life imprisonment was upheld. The defendant now appeals. For the reasons stated…
