The plaintiff appeals as of right from an order of the Alger County Circuit Court entered July 15, 1971, which granted the defendant’s motion for an accelerated judgment and dismissed the plaintiff’s suit.
In March of 1964, a bulldozer owned by the defendant was brought into the plaintiff’s shop for repairs. Plaintiff completed the requisite repairs at a cost of $3800.
Thereafter, a dispute arose between the parties as to whether or not the defendant had authorized the repairs. Negotiations were begun in an attempt to settle the matter.. However, after three years of wrangling, no accord could…
