BINGHAM, Circuit Judge.

This is an appeal from a decree of the District Court for Massachusetts dismissing the plaintiff’s bill of complaint on the ground that plaintiff’s plan or system for which it sought protection by injunction was a gambling transaction.

The bill set out that for advertising purposes plaintiff had devised and used a plan or system contemplating “the gratuitous award of a specified sum of money at stated periods to the persons who may then be designated in accordance with the terms and stipulations of the plan.” Under this plan any person above 17 years of age had the right…
