The employer and insurance carrier in this workmen’s compensation case have appealed from a judgment entered in the court below upon an order of the referee, affirmed by the board, December 12,1940, which reinstated, as of May 18, 1934, an original open agreement, dated December 7, 1931, for compensation for total disability. The controlling facts are not in serious dispute; the controversies arise out of the application of the law to them.
