The appellant presents to us only three assignments of error. One is to the effect that the court erred when it overruled the general demurrer to the complaint; in the other two, the defendant contends that the court erred when it denied the city’s motions for a nonsuit and directed verdict. The first assignment of error presents no technical question of pleading; we shall therefore dispose of the appeal by considering the assignment of error which is based upon the denial of the motion for a directed verdict.
