This matter is before the court on cross motions for summary judgment by Plaintiff RK Mechanical, Inc. (“RK”) (Doc. No. 22 [“RK Mot.”]) and Defendant Travelers Property Casualty Company of America (“Travelers”) (Doc. No. 21 [“Travelers Mot.”]) filed April 15, 2011 and the parties’ consent to magistrate jurisdiction for purposes of deciding the cross motions for summary judgment pursuant to 28 U.S.C. § 636(c)(1) (Doc.
