Appeal from Circuit Court, Kingsbury County. Hon. ChaRles S. Wi-iiting, Judge. Charles E. Ely was convicted of engaging in the business of selling intoxicating liquor without a license, and he appeals.

Upon an information duly filed by the state’s attorney of Kingsbury county, the defendant was tried and convicted of the offense of'engaging in the business of selling intoxicating liquors at retail without a license. From this judgment, the defendant has appealed to- this court.

The information, omitting formal parts, is as follows: “That on the ist day of May, A. D. 1907, and thereafter continuously down to the 10th day of-June, A.
