MEMORANDUM OPINION AND ORDER
(April 4, 2007)
THIS MATTER is before the Court on Defendant C&C Construction’s Motion for Summary Judgment filed January 25, 1999, *265and Defendant HOVENSA’s Motion to Dismiss on the Issue of Successor Liability and in the Alternative for Summary Judgment filed September 6, 2002. On January 31, 2007, the Court heard oral arguments from all parties on these motions. For the reasons set forth herein, the Court grants both motions for summary judgment.
