On March 6, 1985, Thomas P. McCue filed a petition for writ of mandamus against Dr. Jane M. Irmscher, the Fort Wayne-Alien County Board of Public Health (Board) and the Fort Wayne-Alien County Health Board Commission (Commission). 1 McCue’s petition alleged that Dr. Irmscher, the Board and the Commission failed to properly fill the vacancy of laboratory director within the Fort Wayne-Alien County Health Department (Health Department).
