JOHNSON, District Judge.

This is an action of trespass to recover damages for personal injuries sustained by the plaintiff, David C. Albright, based upon the Federal Employers’ Liability Act (45 U.S.C.A. §§ 51-59). The case was submitted to a jury, and a ver-., diet was rendered for the plaintiff in the' sum of $2,000. The defendant has moved for a new trial, assigning a number of reasons therefor.
