Defendants appeal from denial of their several motions to dismiss the complaint on the ground of legal insufficiency. Plaintiff sues to recover compensation for services in connection with the promotion of oil concessions in Venezuela. The case involves the effect of a subsequent agreement on the right of plaintiff to recover on an earlier agreement, plaintiff asserting that the later agreement constituted no more than an executory accord, without satisfaction.
