Mr. Justice Peckham,
after making the foregoing statement, delivered the opinion of the court..The sole question' arising herein is whether the Federal Circuit Court had the jurisdiction to determine the issue involved. That question alone has been certified to this court by. the Circuit Court,' under the provisions of the fifth section of the act of Congress of 1891. The grounds of the dismissal of the bill are set forth in the foregoing statement of facts.
